Welcome to Shiftkart Logistics Private Limited ("Shiftkart Logistics," "we," "us," or "our"). These Comprehensive Terms of Service ("Terms") govern your access to and use of our website located at shiftkartlogistics.site, as well as any related mobile applications, subdomains, and services provided by us (collectively, the "Platform"). By accessing, browsing, or submitting any information through our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately cease all use of our Platform.

1. Nature of the Platform and Services

1.1. Inquiry-Based Model: Shiftkart Logistics operates exclusively as a logistics inquiry and customer assistance platform. We provide a digital interface where individuals and businesses can submit detailed requests regarding their transportation and logistics needs, including household shifting, two-wheeler transport, and truck/goods movement. We do not function as an instant booking engine or a direct transportation provider.

1.2. No Upfront Financial Commitment: Submitting an inquiry on our Platform is entirely free of charge. We do not request, process, or store any payment information, credit card details, or advance fees during the initial inquiry phase. Any subsequent financial arrangements will only be discussed after a thorough review of your specific requirements.

1.3. Evaluation and Acceptance: The submission of an inquiry does not constitute a confirmed booking, a service agreement, or a legally binding contractual commitment on our part to provide transportation services. Every inquiry is subject to a manual review process by our internal team. Service acceptance is strictly at the discretion of Shiftkart Logistics, based on factors such as route feasibility, operational capacity, vehicle availability, and compliance with our safety standards.

2. User Eligibility and Account Responsibilities

2.1. Age Requirement: You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use our Platform and submit inquiries. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding agreements.

2.2. Accuracy of Information: When submitting an inquiry, you agree to provide accurate, current, and complete information regarding your identity, contact details, and the specifics of your logistics requirements. You acknowledge that any false, misleading, or incomplete information may result in the rejection of your inquiry, delays in processing, or the inability to provide accurate assessments.

2.3. Account Security: If we introduce account creation features in the future, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

3. Intellectual Property Rights

3.1. Ownership: All content, design, graphics, compilation, magnetic translation, digital conversion, and other matters related to the Platform are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use, or publication by you of any such matters or any part of the Platform, except as allowed by these Terms, is strictly prohibited.

4. Prohibited Activities

While using the Platform, you agree not to engage in any of the following prohibited activities:

• Submitting spam, bulk inquiries, or automated requests using bots, scrapers, or other automated means.
• Transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform.
• Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
• Using the Platform to facilitate the transportation of illegal, hazardous, prohibited, or restricted goods as defined by Indian law.

5. Communication Consent

By submitting an inquiry and providing your contact information, you expressly consent to receive communications from Shiftkart Logistics and our authorized representatives. These communications may include phone calls, SMS messages, emails, and WhatsApp messages related to your inquiry, service feasibility, follow-up questions, and potential service arrangements. You may opt out of promotional communications at any time, but transactional communications regarding your active inquiries are necessary for our service delivery.

6. Third-Party Links and Services

Our Platform may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Shiftkart Logistics. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. 7. Disclaimer of Warranties

7.1. "As Is" Basis: The Platform and all related services are provided on an "AS IS" and "AS AVAILABLE" basis. Shiftkart Logistics expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

7.2. No Guarantee of Accuracy: We make no warranty that the Platform will meet your requirements, be available on an uninterrupted, secure, or error-free basis, or that any information obtained through the Platform will be accurate, reliable, or verifiable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Shiftkart Logistics, its affiliates, directors, employees, agents, or partners be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, the Platform or from any service arrangements facilitated through the Platform.

9. Indemnification

You agree to defend, indemnify, and hold harmless Shiftkart Logistics and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Platform; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; or (d) your violation of any applicable law, rule, or regulation.

10. Governing Law and Dispute Resolution

10.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

10.2. Venue: Any disputes, controversies, or claims arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, Delhi, India.

11. Modifications to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
